Information regarding Montana Oil and Mineral Rights inherited

I first posted this back in August 2012. I consulted with my attorney and the WILL has been in probate court and anything that was left to my step-mother, I have now inherited. I do not know much about the oil and mineral rights in Montana but I have recently found the locations of the areas.

Those areas are as follows:

Township 31 North, Range 48 East, M.P.M.

Section 27: S 1/2

Containing 320 acres

Township 31 North, Range 48 East, M.P.M.

Section 27: S/2

Township 31 North, Range 48 East, M.P.M.

Section 26: SW 1/4

Section 35: N 1/2, NW 1/4, SE 1/4, NW 1/4

Containing 600 acres

Township 31, North Range 48 East, M.P.M.

Section 35: NE 1/4, SW 1/4

Containing 40 acres

Township 31, North Range 48 East, M.P.M.

Section 35: NE 1/2, NW 1/4

Containing 5 acres

Township 32, North Range, 49 East, M.P.M.

Section 31: S/2 SE

Containing 80 acres

I am not sure what this means. Any help would be greatly appreciated !!

Beverly, you posted legal descriptions as to where your minerals are located (all in Roosevelt Co). However, it appears you have some errors in this data. As an example, the first two entries are both describing the same tract of land (31N 48E, Section 27: south half). It's possible you could have two interests from separate sources under the same piece of land, if not you've included slightly different descriptions from different sources of the same minerals. Your next entry for Section 35 is similar. Your description in part states "N 1/2, NW 1/4, and NW 1/4". Since the northwest 1/4 is part of the north 1/2 there is no need to include that "NW 1/4" even once (nor twice).

Since you're new to all this I'd suggest you look near the top of this page for the tab "Mineral Help" and start reading through some of the basics such as "Oil & Gas 101". Start by learning how to read the legal descriptions so you'll be comfortable with those. Then understand the difference between "Gross" acres and "Net" mineral acres. In short your legal descriptions include the GROSS, ie... the land under which your minerals are located. The NET is the amount of minerals you own under those lands (as it's not necessarily 100%). This appears to be what you're describing with your "Containing 80 acres" comments. Make sure you're familiar with this concept as well.
