Incorrect Legal Description on Mineral Rights Lease Offer

A leasing agent contacted my sister about leasing some mineral rights. She sent him an affidavit of heirship, and he sent each of us (four siblings) a lease offer. Only two of the siblings signed the lease.

The lease states the lessor agrees to warrant the deed, "defend the title, and to indemnify lessee of all adverse claims thereto, and all expenses incurred by lessee..."

Upon investigation at the county courthouse, it was discovered that our mineral rights come from the east half of a quarter section of land instead of the west half as was stated in the lease.

What actions, if any, need to be taken by the mineral owners regarding the signed leases? No lease bonus monies have been received. Thank you.

Affidavit correcting the description. I'd suggest the leasing company do this. Had to do this once myself; I went ahead and filed the correction as I didn't want to cloud someone else's title.

I actually filed a "Scrivener's Error."
