My family has about mineral rights in 12 different counties and multiple properties. We tried doing affidavits of heirship but now understand that doesn’t always work. We have interest in Roger Mills that just started drilling and we are worried we may lose getting paid if we don’t get property properly deeded.
I’m willing to hire an attorney or landman. Just want guidance on fining the proper person
You can search the OK Bar association and look for specialty in family and estate law or something along those lines. There are also several OK attorneys who post in the OK mineral rights topics.
Is your opinion that the lawyer route is the way to go? Versus a landman?

I prefer to get a good lawyer I can trust. I already know one lawyer who qualifies but wanting another option or a way to vet the lawyer.

We went through this process twice. Oklahoma doesn’t recognize out-of-state probates, so we had to find Oklahoma lawyers. Can you say, “home cooking.” For a property in eastern Oklahoma, we engaged Don McFarland of Okemah (Okfuskee County) and for property in western Oklahoma, we engaged Evans Davis of Edmond. The western Oklahoma property was in Major County, where my late wife grew up, but no lawyer there would accept us as a client, so we finally found Evans Davis, and they did the job, though they were expensive, at least to a retired old fart up in Maine.

Landmen are great at finding information. I used them when I need to find historical data. I use attorneys when filing probates and transferring deeds that will pertain to the present and future. OK is picky about probate being done properly for out of state people and requires a “foreign probate”. Even for OK residents, affidavits of heirship are not the best option for getting royalties due to the ten year time frame. See comments by Tim Dowd and Richard Winblad on the forum.
