How is title obtained for mineral rights?

Mother recently passed. I have 3 tracts that I need to find out if she has ownership of the mineral rights. How do I find out?

The answer will vary greatly state to state.

Location is Carter County in Oklahoma

Descriptions are as follow:

1. Section 5 Township 3 South Range 3 East

2. Section 7 Township 3 South Range 3 East

3. Section 13 Township 3 South Range 2 East

My mothers' name is Claudette Colbert-Cross, and she recently passed on December 14, 2013. She was mentally ill and I'm afraid she may have been overlooked due to her illness, or worse, taken advantaged.

I don't see anything that actually changed hands except to you. The hyphenated name may cause some search issues, but it looks like section 7 was leased in 07.

Likely you will need to probate the estate in Oklahoma, but you do need to figure out what she owns.

I see where she transferred ownership in Section 6 and 8 of 3S 3E to you. I also see where she leased Section 7-3S-3E to RD Williams in 2007. XTO Completed a Horizontal Woodford Shale producer in this section in 2012.

Her lease would have been expired, unless they extended the lease, but I don't see anything filed in Carter County telling me the lease was in fact extended. Her name does not appear on any Pooling order.

It's always the toughest advice, but I would get in contact with someone at XTO, because it appears your mothers estate is definitely due royalties.

I'm sorry, It looks like Wagner Brown drilled a Horizontal Woodford producer in 2008, so the interest owned by your mother was HBP at that time, and still is. XTO now operates that well, the Ardmore 1-7H, along with it's new producer the ARDMORE FOUNDRY 1-7H.

Your mothers estate is definitely owed some money....

Thank you for all your help. I was recently told by XTO that they had given me the incorrect description that my mother used to Quit Claim Deed 8-3S-3E into my name!! The description should have been 7-3S-3E!! If my mother were alive I could have corrected the problem by filing a "Deed Correction" document. This is now in suspension until I can get this transferred into my name. How do I do this now that my mother has passed?Do I need to pay for an attorney? I hope you have a great solution that would not be too costly.

XTO has it in their notes that my mother did attempt to deed 7-3s-3e to me, and how it was their erroneous information for the error.
