My father passed and he did not have a will, but my mom had power of attorney. We signed some oil leases six years ago and have not heard Nything crom them since then. The leases expired five months ago. What should we do? Thank you.

Records on file at the County Clerks office in the county where the minerals are located. What length term were these leases? Back then, a 5 year lease was the norm for lease terms. When you verify the status of these leases, you can always market these minerals to other interests. I would do some research and find out what companies are leasing in your area and proceed to make contact.

A power of attorney usually expires upon the death of the grantor of the POA. However, your mother may be considered next of kin in the state where the minerals are located. Get a death certificate for your father and ask an attorney in the subject state what to do next. If you have copies of the leases you can contact the county clerk and check the status or contact me and I will see if there are any wells holding the acreage.
