How do I obtain a copy of a mineral lease

I recently purchased mineral rights in Harper County, Oklahoma from a family member who does not have a copy of the lease to the oil and gas company. How can I obtain a copy, so I know the details of the lease?

You can do a free search on www.okcountyrecords.com and use the Advanced search option in Harper County and see if there are any filed. The digital records may not go back to patent.

You can also post the section, township and range here and we can tell you what the active wells are and who the operator is and you can usually get a copy from the operator for free. If there is an active well, you must contact the Division Order department of the operator and do the paperwork they require in order to get into pay.

  • Section 3 - Township 26N - Range 25W
  • Section 27 - Township 28N - Range 25W
  • Section 29 - Township 28N - Range 25W
  • Section 33 - Township 28N - Range 25W

Garvin County, Oklahoma

  • Section 22 - Township 4N - Range 3W

If you have any documentation about the Landman or the middleman company that helped with procuring the lease, they usually have a copy of the lease before it is filed. We signed 2 copies of ours - 1 for the driller and 1 that stays with Halo Land Management just in case it’s ever needed for future issues. Might try that.

@JA_OWNER I believe these leases are over 30 years old and have passed through a couple of generations of family. No one is alive who was around when the leases were signed.

Landmen and leasing companies come and go. They have no legal obligation to retain your lease for the decades it may be in effect. It is important to retain copies of your leases in your own permanent files if only a memorandum of lease is recorded.

  • S 27 - T 28N - R 25W-Changos LLD, T J Smith inactive, Oil Producers Inc of Kansas-Wilmont well inactive (lease would probably be expired)

  • S 33 - T 28N - R 25W- Foundation Energy Genevieve inactive, Latigo - Beene B 1,

Garvin County, OK

  • S 22 - T 4N - R 3W-Charter Oak-Boomer 1-22, Exxon-Street , rest of the wells are old Daylight wells

Your exact location within the section may determine which wells you may be in. Depends upon the spacing.
