I have a small royalty interest in a producing unit in Midland Tx. I leased it to Permian Deep Rock. They have drilled and are producing 23 wells in the Knight Unit since Sept 2024. I have not received division orders, so no payments to me. I called several times and am told they are working on it and if I am not happy, I should sell my interest. I don’t want to sell, I want to be paid. Is there any regulation on how long they can wait to send division orders to owners? What are my options? Thanks for any insight
Some areas can have extremely complicated titles that require significant time before Division Orders can be prepared and circulated. Since the CAD prepares tax roles from a DO, you can check the MIDland CAD website to see if the wells have been posted.
In addition to James’ comments. Send a demand letter by certified mail return receipt so that you have documentation. Request a division order and payment with interest. That starts a clock ticking in TX. Give them a description of your acres and a copy of your lease. Keep copies of everything that you send.
