Haven't received division orders and well shows runs for 5 months?

We have mineral rights on 19-152-104 where the Eveland 30-19 1H well is. It has shown runs on the NDIC production report for 5 months now, but we have yet to receive division orders. I can't seem to get an email or phone answer from Statoil. I did get a call back several weeks ago, but the person just said that they were behind and hoped to get caught up this first quarter of 2014. She didn't look up my particular problem....just that they were behind with everything.

Any suggestions?

Make sure you don't have any title defects so you can collect the interest? It's not all that uncommon for them to take a year to get the checks out after first sales. Many operatord do their best not to pay the interest. I just received word from one today that I did not request interest. I think they forgot that the law has been changed that they must pay interest whether you request it or not, because so many tried to doge it and give mineral owners a hard time.

Since you are sure you have an interest in a well, take Mr. Kennedy's advice and document your chain of title. You will get the money back but more importantly, You won't be in doubt about your decimal interest when a Division Order does show up. A title abstract could get your royalty payment sooner if there are title flaws you must correct before getting paid. All operators are behind schedule and don't suffer much penalty if they are late and no penalty if your have title problems. If you are prepared to confirm the DO, you will get the correct payment faster. Certainly, you won't get paid until you agree with their interpretation of your title.

If you cleared title with some of the lease bonus money, you are in good shape. Now just be patient. Keep in mind that if the operator gives some of your money to others, they are liable. They have the incentive to make the distribution correct the first time around.

Don't depend on leasing agents to do good title work. They don't have time and just want to lease up the "apparent owner" just to make sure everybody gets covered and they get paid. GLH
