The Texas Chapter of the National Association of Royalty Owners is working on this issue now due to recent Supreme Court of Texas rulings. A simple cut and paste would be a very bad idea. Always wise to get a good oil and gas attorney who is also knowledgeable about surface owner rights to look at the lease. You need to know if this is a saline aquifer lease which belongs to the surface owner’s realm or if it is brine produced water from an oil and gas well (mineral owner’s/operator’s realm.)
