If Merit has that section why wouldn’t they just drill deeper?
If they change the lease wouldn’t it have to be renogiated?
The Purdy Unit has changed hands many times over the years and whoever holds your lease has the rights to all formations as long as they have production . They can make a deal with anyone to drill any formation, they have the lease and can handle it as they want and you get the same royalty interest on anything that is drilled under you .

I remember seeing his name on the list of respondents and I thought of your family @ the time. What a pleasant surprise. I knew the name of the well when I received some correspondence from Hal Smith’s office on Oct 17th attempting to settle some title issue. Something about a cross conveyance. ? The request they sent me made mention of the well by name-first time I had knowledge of the name. I assume it is a work in progress. Not sure who owns the surface but maybe Paul or one of his sons (??) I have been meaning to text Dale to ask him but keep forgetting… Do you have an interest in that well? We’ll be in touch as things move forward. Again, so nice to hear from you. I love this forum (for the most part).
Looks like there have been some motions, hearings conferences etc. concerning some issues several companies have with the pooling of sec 33. I’m guessing they are working interest owners making sure they get a fair shake on the deal.

As I understand: In theory the Vertical Pugh clause can release formations above production as well (I think a different term is used). You get this if you are pooled. I’ve not had any luck getting this in a lease. But the State of Oklahoma’s standard lease has it and reads:
5. (A) … It is expressly agreed that this lease shall terminate as to all non-producing intervals, if unspaced, and all non-producing common sources of supply, as spaced, at the expiration of the primary term of this lease.
Presumably the state has a little more leverage than an individual mineral owner
To me this is one of the main reasons to wait for pooling on these deep wells. If you don’t, you end up with all of the minerals above held by production – seems more significant than releasing the minerals below for the Woodford wells.

Does anyone have experience with Greenstar Resources they would care to share? They’ve made offers on several sections where there is pending spacing/pooling from NFX (16-3n-4w) & CLR (22-1n-1w). Their offers are good (I’ll post specifics once I get them sorted out).
Linda, thanks for the update on the Studdard. Sure has been a long time drilling on that one. I would like to know what you saw south on 76. Not sure if it would be 1N 2W or 1N 3W. Did It look like I was close to the highway? I may have to drive down there and take a look
Hutch, the unit is 160 and I own 80 acres. 1/8 royalty. Don’t know where the 8/13 came from?
I will tell you in what context they used it. For 8/13 production transfer interest . They say my interest is .00113415. Not sure how they came up with this?
Pam, I’m not sure about the May date, but I think it probably means they have 6 months to do what they requested permission to do. I’m sure someone can correct me if I’m wrong. I have not seen the document you saw on OCC website. I talked to Dale awhile ago and he said the rig is not too far from his house, and it is not “on us.” He also said they DCP is laying pipeline across John Harrell’s land and he guesses that’s what the bridge is about. How did you access the documentation on OCC that made reference to 5/14?
Sorry Vicki, all we saw south of highway 29 on highway 76 was that rig sticking up. We didn’t go down that road but Preston said he didn’t think it was very far off of the highway but he thinks it was probably on the east side of the highway 76. (I know Harrells live on the west side). I couldn’t remember for sure. Do you have minerals down there?
Vicki the rig Linda saw off hwy 76 must be east of the Foster cemetery. My brother, Ronnie drove down that way & that was the only rig he saw. However they were building a bridge & a way into the SE corner of Johnny’s property. There was a date of 5/14 on the OCC website after it being recommended. Do you know exactly what that date refers to?
Karla, apparently I didn’t click “add comment” after my answer to you yesterday. If you don’t have the information anywhere in your documents you could contact the operator, Chesapeake? and ask how they arrived at your net royalty decimal or the Landman you leased with. As a last resort a title search would have to be done at the county clerks office.
Rick Howell is an expert on this and might have some suggestions I didn’t think of.
Karla, the part about rev DO could be better answered by Rick. The 1/8 lock in would depend on the terms of your lease, sometimes a depth clause in the lease will limit the operator to a certain depth or formations and a new lease would be required. In some cases you could be leasing formations to different companies

Sondra, the $35. a year with those people is a waste of money unless you have moved around a lot and people might have a hard time finding you but if you are recorded with the right address and have already been contacted by the companies save your money.
