Forced pooling timeline

I have mineral interest in Sec 34- 6N- 7W Grady County. Camino is planning on drilling the Bennett well there. I did not accept their pre-pooling lease proposal and am not participating, choosing to go to forced pooling. Looks like copies of well permit came yesterday. At what point will they send me a letter so I can choose my option on royalty and bonus and get it back within 20 days? Is it soon, pre-drilling,or after drilling? Thanks, Ray

Ray, in order to officially force pool you they have to have a hearing at the OCC first. The hearing for your interest here is not scheduled until July 15 so if an order is issued on July 15, they should start sending letters out within three business days after that, telling mineral owners who are included in the pooling of their options.

Hi Ray, I received the pre-pooling offer as well. Way too low in my opinion on any option. The approval to pool S34-6N-7W will be heard on July 15th. I received my notice by OCC last week.
I’ve been contacted by 2 leasing companies wanting to lease, but the price is still too low. $1250. Per acre for 3/16 lease. Hope this helps!

The pooling options that will be listed in the order are the ones that are in the market. In other words, the objective facts of what companies are leasing for.

Even if a respondent thinks the options or money to be paid should be greater or higher, the OCC is not going to allow that to be an option if nobody is offering that amount or there is no evidence has been offered to show the higher amount.

I have heard mixed recommendations on forced pooling. I have been told that forced pooling is a good thing and that I should just wait until that happens. Others have said if you wait for forced pooling you are going to receive the lowest offer. Both thoughts can’t be right. I would think waiting to be pooled would not be a positive thing as you would lose your ability to negotiate a better deal at that point?

Forced pooling in OK will offer a range of options for royalty/bonus pairs based upon the competition in the area. Most savvy mineral owners will pick the highest royalty offered (lowest bonus) versus the lowest royalty and highest bonus. The bonus is a one time payment. Higher royalties on a successful well over many years may far outweigh the bonus. Generally, the range of options is based upon the highest offering for leases by the operator within the last year. Attached a summary for you.

You have 20 days in which to answer a pooling order. If you can negotiate a better lease in that time frame, then you can do so. Be mindful of the deadline because if you do not answer within the 20 days (certified letter return receipt), then you will be assigned the lowest royalty. Given the timing of mail, I set my calendar at 10 days to respond.
