Finding the correct Operator

Trying to drive closure to some land interest in the family due to deaths. Needing to file affidavits of heirship for the following area and trying to locate the current operator or verify 4 year old information. In 2022, I was told that this owner interest in Stephens county section, township, range above was brokered for Continental by Turner Oil. Can someone verify or provide the correct operator so we can find out what their document requirements are to change ownership accordingly. Section 7-1N-5W Stephens County Oklahoma

Start with Continental Resources with the Harmeyer 1-7-6XHW well. Be ready with death certificates, affidavits or heirships or probates, driver’s licenses of heirs, etc. Contact their royalty owners division or their Division Order Division.

In my experience, in Oklahoma Affidavits of Heirship may or may not be accepted by oil companies in order to pay. Additionally, the affidavits do not transfer ownership out of an estate. Only probate can do that. The ownership would have to be transferred in order to sell the minerals. If there’s any thought that the minerals might be sold someday, then the sooner the probate is accomplished, the better. The more time that passes, the more difficult it could become. A summary probate might be possible which is less expensive than a full blown probate. (I’m not an attorney. Just speaking from personal experience.)

A_Monty is correct. And makes good points. You may want to check with the operator’s division order analyst for their requirements to be placed into pay status. Summary probate may be available if either

  1. The decedents died while residing out-of-state; or
  2. The value of the property subject to probate valued less than $200,000; or
  3. Five years have passed since the death.

If there are several decedents, it is often possible to roll them into a single probate.
