My father inherited mineral interests in Goshen & Platte Counties, WY. My sister and I, as beneficiaries of our father’s estate, want to split the interests between us. I am having difficulty finding a title company to do a title report to verify the ownership interests. Any suggestions?
A landman can trace the title to determine net mineral acres in each tract. Are you trying to divide so you get all of Tract A and your sister gets all of Tract B? You will then need to value each tract. Or just that you each receive 50% of every tract? Then you can consider filing deeds in each county with the legal descriptions that you have and include language that include all interests owned in the county by your father. An oil and gas attorney can help you get this done correctly.
In my case I would rather own an undivided mineral interest in each tract. If the undivided owners could and would lease as one using the same lease it would be to your benefit in most cases, at least from my stand point. If you have one tract and the other has a different tract and they drill on the other tract you would not like that.
