Section 20, Township 4 South, Range 3 West Carter County Oklahoma. Today I became the executor of my dad’s estate with mineral rights in Carter and Caddo County. Don’t have a clue as to where to start. Any help would be great. Thank you.
Gene:
In regards to the mineral rights, I believe a “Quit Claim Deed” might suffice in your case. You can google this or google on this forum to view past posts regarding this document.
Thank you. I have all the documents where my dad leased the mineral rights to different companies during the 60s up to 1990. Everything seems to stop at 1990 and I’m not sure if this is because of my dad’s health or what.
Gene,
There are three producing oil wells in that section of land.
Do you happen to have the tract description? SE/4, NE/4, SW/4, NW/4?
I have 2 tracts in this section that total 99 acres. I will just write what I have on a quick claim deed.
N/2 N/W4 N/W4) (N/2 S/2 NW/4) (W/2 NE/4 NW/4) SECTION 20, TOWNSHIP 4 SOUTH, RANGE 3 WEST.
TRACT 2 (S/2 S/2 NW/4 NW/4) (SW/4 NW/4 SECTION 20, TOWNSHIP 4, SOUTH, RANGE 3 WEST.
Thank you for the question. Gene
Well, there isn’t any production in the NW4, so that won’t be an issue.
Was the estate probated in Oklahoma?
I paid an attorney to have a court in Carter County to make me the executor of the estate. That was $500. The firm wants $2500 to get the will probated. At this point I think why go to the additional expense.
As long as the court order allows you to sell/lease the property owned by the estate, I don’t see any reason why you would need to.
