Does every mineral owner receive offer to lease, or is lease only for person who owns minerals where the well will be sitting

minerals located in oklahoma. if i own 10 acres of minerals in sw sw sw of a section, & the rig is sitting in nw nw nw & the spacing is 640 should i be approached by the drilling company with a lease offer? or is the lease only offered to the mineral owners under the nw nw nw?

Everyone within the spacing unit participates, either through being leased, paying their own way, or being force-pooled. Either way, you should receive some sort of communication. I haven't worked OK in a few years, but it used to be pretty easy to force-pool there. Maybe someone with more recent experience could comment.

Ann, Yes you should be leased. In a 640 acre unit the actual location(nw nw nw) does not matter, in other words anyone owning rights in the section that is producing oil and/or gas gets paid. In some cases there will be a "surface location" where the drilling rig is sitting but the horizontal bore goes into the next section and produces from there. In this case the mineral owners in the section that contained only the surface location will not be paid. In another scenario 2 or more sections get drilled as one continuous well bore and mineral owners in all producing sections get paid proportionate to the amount of acreage they own.

Steve, I don't think the pooling process in OK has changed any.

thank you for that information, apparently force pooling took place because I have received papers that were sent to the corporation commision. horizontal drilling rig sitting in sec 14-4-6, with 33% in that section, will drill into sec 23-4-6 where the remaining 67% will be. so i guess i wont get a lease since its force pooled, but will receive some payment.

I have a question concerning a different situation. apache drilled a location approximately 2 months ago, section 12-5-6, minerals were in deceased grandparents name, but parents transferred into our name, documents were filed when drilling was being done. neither we or parents or deceased grandparents were sent any lease option or for that matter, we were sent nothing. i contacted & mailed copies of proper documents to apache corp. i am new to all this so please any information is appreciated. what im asking is where do we stand since we own mi erals but were not contacted, & still havent been, but a rig has been drilled?

Ann the answer to you first question is, maybe, maybe not. It depends on where they drilled TO, not necessarily where it is drilled FROM on the surface. So the answer will be on what the spacing unit they permitted and drilled shows. That is probably accessible on www.occeweb.com which is the regulatory agency in Oklahoma that handles the drilling permits. In Texas the permits have a survey (map) that shows the boundaries of the spacing unit. Some of them are much easier to read than others, but I am usually looking at urban permits where all of the boundaries are located in the city, so we don't have clean section lines like rural Oklahoma does.

Does anyone know how to find spacing on the occe website? I can’t seem to find out how to do it?
