We signed a Three year lease with Chesapeake in 2004 for our mineral interest in Grady county Oklahoma. They did not drill or re-lease. Chesapeake will not return my calls. Any ideas on how to proceed and who to contact? Thanks
Good luck getting a release out of Chesapeake. Have you checked to see if the lease was assigned to anyone else before it expired? If so, you would have to get a release from whoever owned it at the time of expiration.
Most landmen in the courthouse would look at your 3 year lease and then check for any production or permits on your land, if they see none, they will assume that the land is open for leasing and cure any title defects after the fact.
If this concerns you a great deal, you could file an Affidavit of Non-production with the Grady County Clerk. This doesn't completely clear the cloud on your mineral title, but it will be sufficient to let others know that your land is available for leasing.

I deal with Chesapeake all the time and....they use Lowry's landmen to make the offers. prepare leases etc. I deal with the same couple of guys and they hAVE BEEN SO EASY TO WORK WITH...I can giveyou some names and #s fo them if you are interested...at least you get intothe phone system and talk to human and they can direct you tothe dept that would handle your problem...let me know

In Texas is it necessary to get a filed release from the company?
If unable to obtain one would I need to file an Affidavit of Non-production with the County Clerk like in Oklahoma?

Wilson, I think it would be reasonable and cheap insurance to record the affidavit of no-production. I would also send a copy with tracking to the lessee.

Unfortunately, getting an oil and gas company to file a release is like pulling teeth, even if filing a release is clearly spelled out in your lease.
