Dividing ownership of a mineral rights deed

We have a mineral rights deed that is in the name of a family trust. The 2 beneficiaries would like to split the owership, so each has their name on a separate and distinct deed. How would the Trustee go about accomplishing this?

Generally, the trustee would record a distribution deed to the beneficiaries. The minerals would then no longer be in the trust. The ability of the trustee to distribute trust property to the beneficiaries is determined by the terms of the trust. It can trigger state and federal tax consequences. You should consult an estates and trust attorney about the process and to prepare the deed and a tax advisor about taxes. If the trust and the minerals and the beneficiaries are sited in different states, there may be more issues which need to be determined.
