We have just found out that we are 1/4 mineral rights owners on a 100 acre lease. The oil co. did not know this and neither did we. I would like to find out what the bonus payment is going for in this area. I don't want to get a lawyer just yet, but feel I will have too. I believe the oil company is trying to get use to sign fast because they are allready set to start fracking and just waiting for us to sign the lease. they have already drilled and waitng for us.
You may want to post a legal description of your minerals so someone can look up the type of well, nearby activity, etc.
From the way you worded this post, it sounds like you inherited some minerals and the producer was unaware of the change in ownership. But if there is a current "100 acre lease" that includes your 1/4 mineral interest therein, then you are not going to get a bonus payment, at least not until the lease expires, which might take years, even many years if the well(s) is successful. I am trying to figure out what they are wanting you to sign if your mineral interest is in fact currently leased. Could it be a Ratification? I doubt it. Either way, send them copies of any documentation that places title to your undivided 1/4 MI in you (such as a Probate or Affidavit of Heirship). Certified copies from your County Clerk would be preferable.

We have just found out that is exactly what happened. It was in error on all parties involved. we were never notified by the oil company. We are currently weighing all options. Thanks to you both and will be aking more questions in a few days, I am sure.
