Deed of royalty

My deed of royalty says all interest in and 1% royalty. Since there were no leases on this property, can I assume that I have mineral rights? According to past wills of grandparent, he conveyed mineral rights at that time, 1926.

It looks like you have a royalty interest in and to the described lands. What year was this instrument made?

In 1926 this is what my grandfather had… now grants to …all the real property situated in Teton County Montana described as follows. A full and undivided (50%) of all the oil, gas and other minerals and hydrocarbons in, on, underlying, produced and saved from the lands in Teton County Montana described below. THIS IS THE SAME DESCRIPTION THAT I HAVE IN MY DEED OF ROYALTY. MY GRANDFATHER DIED IN 1929 AND LEFT THIS TO HIS 3 SONS. MY FATHER WAS ONE. MY DAD’S OLDER BROTHER WHO WAS A LAWYER AND EXECUTRIX OF ESTATE. THERE ARE NO DEEDS THAT I KNOW OF THIS HAPPENING. MY DAD’S BROTHER LATER LEFT IN (1939) THIS DEED OF ROYALTY TO MY FATHER. THE ONE THAT I TYPED OUT FOR YOU. BUT THIS DEED OF ROYALTY COMES FROM THE LAWYER (MY DAD’S BROTHER) AND HIS WIFE. MY FATHER LEFT THIS DEED OF ROYALTY TO ME WHEN HE PASSED. IN 1975.

From the information provided I would say that you have a non participating royalty interest. And that you are entitled to a full 1% of production from the lands described, however you do not have the power to lease said lands and are subject to the mineral owner making an agreement with an operator, their royalty will then be burdened by your NPRI.

THANKS. I WAS THE SURVIVOR IN MY UNCLE’S WILL (THE LAWYER) AND HE NEVER MENTIONS THIS LAND SO HE MAY HAVE SOLD THOSE MINERAL RIGHTS. IN THE EARTH MAP I SEE HIS NAME ON A COUPLE OF SECTIONS SO I DON’T KNOW WHAT THAT MEANS. THANKS AGAIN AND I AM GOING TO MONTANA THIS SUMMER AND WILL GO TO THE COURT HOUSE AND DO SOME RESEARCH.
