Death of Parent

Father passed in 2007 and my Mother in 2013. My Brothers and I are receiving calls from Blaine County, Watonga Oklahoma Oil Companies in reference to mineral rights my parents have. What steps do I need to take now. My two Brothers and I share equal shares from Trust, leaving me with the power of attorney on mineral rights decision. Tell me the steps I now need to do to get mineral rights switched over to us and recommendation on renewing lease or accepting a new lease for the three of us.

Hi Rosemary,

You were not too clear and a little too vague leaving out a few of the details needed. You speak of a trust and of having power of attorney, is the mineral interest in a trust with you and your brother as co-trustees and you have power of attorney for your brother? If power of attorney was for mother or father that ended when they passed. If the mineral interest is in a trust the trustee(s), depending on what the trust says and how it is set up, generally the trustee can convey the interest, one would need to know exact details of and within the trust. Normally one would file the trust in the county along with a trustees deed conveying the interest as required or stated in the trust as to beneficiaries. If the trust document states the legal descriptions I would record as a stand alone document rather than attachment. I have been buying mineral rights in Kingfisher and Blaine County, activity has been good in certain parts of the counties.
