Continental Resources overpayment

A family member has the same name as another CR mineral owner in another well. CR confused the two and paid royalty to my family member for an interest owned by another party. CR is withholding royalty payments to my family member until the royalties due meets/exceeds the overpayment amount.

Recommendations?

That is standard procedure for oil company to recapture funds paid in error, whether to wrong party or an overpayment due to error in calculating well revenues. Most royalty owners prefer this and not to send a payment to the oil company.
