Can exclusive rights be sold to another entity with the surface property they own?

similar to your previous post, not sure what the exclusive rights are. In Texas, the surface and mineral interests are two separate estates. You can sell the surface and keep the minerals or vice versa. It sounds like you are about to sell surface with exclusive rights to "?". In Michigan, you can separate the two estates, but the minerals return to the surface owner without some positive action by the mineral owner every so many years--don't remember the actual number. As i said in the previous post, sounds like you need an Illinois attorney with real estate and oil and gas expertise.
