How and why do we delete warranty clause? Is 200 an acre 3 yrs and 150 acre for next 2 with royalty 20 percent fair for area? Family has small acreage split 4 ways so we need to agree. Any others out there?

You want to delete the warranty because with that warranty, you agree that if the company discovers that you don’t own the percentage of mineral rights that they thought that you did, they can demand that you pay back any bonus money or royalties that you have already received. You don’t want to be stuck having to pay back hundreds or thousands of dollars that you may have already spent because the company’s land department made a mistake.

If they make a mistake in title, let them be the responsible party.

Seriously is there any activity in Borden County Tx right now? Chesapeake leased heavy in 2011. Understand they are in trouble. Is anybody leasing or buying out there now?

Dan, It doesn't look like there has been leasing activity since September of 2012, however, it does appear that 2 drilling rigs are in the county, both on the West side of the County. Primex is to the North and RAW is to the South.
