My four member family each signed two leases on 5-7 and 6-4 that were to be paid in 45 days. To date one person has received one check. After several phone calls and several promises we still don’t have our money. What is our recourse?
Thanks

Another reminder to never hand over a lease without getting a check the same day. You do not want a lease filed without being paid. Not getting paid does not nullify the lease (in many states).
Send a certified mail return address demanding payment. Ask the person who received the check what the paying company name and address were so that you know where the money is potentially coming from. Especially if the name and address were different that the name and address on the lease. Documentation is important. Have a W-9 ready.
In New Mexico if the bonus was less than $10,000 per individual, you can file a small courts claim.
I had a situation in Texas 2 years ago where my $18,000 bonus had been misdirected by an email spoofer. In this instance, the company paid – just not to the right party (me). I took the oil company to small claims court (where the limit is $20,000), and within a month received my bonus. I did that while in Australia, so it is possible to handle the matter remotely.
Thank you, We will do what you suggested.
Thank you… hope we don’t have to sue them.
