Application to change spacing and establish horizontal drilling spacing units

devon and i have not agreed on leasing my mineral rights in sec 23 20n 3e. i have now received an application they have filed with the corporation commission to vacate existing spacing and establish horizontal drilling and spacing units. how does this effect me?

Their next step after they get the spacing will be to file a force pooling for anyone who has not leased . It is nothing to worry about. I'll see what I can find around you.

Jerry, The new spacing just means Devon is probably getting ready to drill in your section. If you don't want to participate with your interest you will still need to sign a lease. Third parties have been paying better bonuses than Devon and giving 1/4th royalty interest instead of 3/16th, so you might want to lease to a third party. However, Devon may force pool your section before drilling and you will receive a force pooling notice with options to lease to Devon for the bonuses and royalty amounts set forth in the pooling notice or participate and sign a joint operating agreement then pay your fair share of the drilling and completion expenses. Third parties often like to wait until your section has been pooled before offering to lease your minerals and give you a better price then, but I know a company that might lease before you are pooled if you don't want to wait. We are about to receive a lease agreement, I think. It has been held up because of requirements the title attorney for Devon said we needed first. I am acquainted with pooling and want to avoid it. Will appreciate any information you can provide.
