BACKGROUND 432:
FIRST LEASE:
In 06 my mother signed a lease with TAPO Energy. The leases expired 2 months before she passed away in 08.
DIVISION of 432
Grandparents:
Marcelene & Alvin Nicholson/ 216 total mineral acres
Their 2 children Carolyn & Gary.
Mom:
Carolyn.
Brother of Carolyn/ My uncle: Gary.
When my grandfather (A) passed away, he transferred 1/2 of all mineral rights to his 2 children (Carolyn & Gary) and 1/2 to his wife (M) to distribute as she pleased.
Upon Ms death, she transferred the other 1/2 of the mineral rights to the same 2 Nicholson kids.
However, Carolyn’s 1/2 from Marcelene was put into a Trust outside of my Mom’s hands. Gary was the executor. Antero does not have a lease with both Gary and mom’s signature from the 2006 TAPO lease.
Since then:
Antero has sent leases, modifications, back dated contracts the latest being a 2013 lease ratification. The person who sent the ratification is not responding to any of my communications.
CAN’T GET RESPONSE from Antero once I ask for better terms.
Everyone keeps passing us off to the next person in line or never responding. This issue seems to be over the head of the landmen. I’ve been looking for answers for months. It would save so much time if I could speak with an Attorney from Antero directly. I’m so frustrated. I am running out of ideas to elicit a positive response from Antero.
Pooling is not the issue on any of the ratifications.
We Would Like To Receive:
My sister and I want to get this signed asap.
We would like to receive increased royalties and a signing bonus for the remaining 18 acres mom did not have the right to sign for in the 2006 TAPO lease.
We would like to retrieve our escrow and we would like to put this matter behind us.
Also, my sister and I are not receiving complete royalties from the 432? There are 2 surface producers on the 432.
1.) TAPO Energy
2.) Antero
TAPO and Antero splitting 15 small wells. I can provide API if needed.
TAPO is paying 1.40%. Antero is paying .64xxx % something. I can send paperwork to verify? I’m guessing this is where our escrow comes into play?
Please help us! What is going on here?
We aren’t making demands just wanting to open lines of negotiation. But we can’t get past the 2nd step of getting Antero’s perspective.
