Has anyone one ever had issues in a mineral rights sale or lease proceeding. I have several relatives that have recent need to transfer their parents rights. And I have another niece and nephew that have already used the Affidavit of Death and Heirship to transfer ownership but it has been the ten years (2014) thanks for any help you can give me we are in Roger Mills County
When my parents passed, a few years ago, their mineral rights are in West Virginia. We used a local (WV) attorney (Kyle Nuttall) to assist with filing at the local court house. We all are far away from WV. You might want to contact the local county clerk and an attorney for your state.
If the ancestors lived in another state besides Oklahoma, they will need to probate the wills in the state of residency and then do a “foreign probate” for Oklahoma. Not all have to cost a lot. There are quite a few threads along that line in OK. Look for Richard Winblad who is a frequent poster and OK NARO board member.
Martha, one can start a probate in Oklahoma without having the domiciliary proceeding done in the decedent’s home state.
Thanks! Always good to have an expert chime in. Was going off what I was told when my mom passed in Texas and we had to deal with OK affairs.
This would probable qualify for a summary probate proceeding without the need to travel to Oklahoma. Usually wrapped up within 60-75 days from filing. Tim is correct, no home state probate is required.
