Already leased property included in a pooling order

Pooling Order Cause CD201302711-T Order #613572

Harper County 26N 26W Sections 33 & 34

I have mineral rights in the NE/4, SW/4 and NW/4 of Section 34. The rights in the NE/4 are still held under a lease dated August 1952 that also includes property in 26N 26W Section 27, of which there is an active well. Best I can tell there has never been any well activity in NE/4 Section 34.

The above pooling order would, of course, include the NE/4 of Section 34. I'm wondering if anyone has any tips as to how I might get the NE/4 in Section 34 released (Sheridan Holding Company).

I'm assuming if Sheridan won't release the NE/4, they would received royalties from the pooling order? Does that mean that Sheridan would than have to pay me under the lease agreement? I may be way off in left field here so appreciate any help I can get before I make the phone call to try to get it released.

Dear Mr. Bates,

Whether Sheridan joins or not, if the pooling order covers the entire section and Sheridan would owe you your royalty whether they received any money or not.

Thank You for your response. Would Sheridan maybe look at it like it would be easier to release me from the lease than to deal with the royalties off of a well they don't own? Just trying to find an angle that might work to get released from my old Lease.

Thank You so much for your input. All us newbie's learn so much from all of you!
