I own a ranch in La Salle County Texas. I am in the process of building a house. Now I found out that my neighbor across the fence has sold part of his property and an oil company is going to put in a gathering station. If I proceed with the home building can they still put in the gathering station? They have not broken ground at this point. I am in the process of getting the dirt work started. Where do I stand? I don't want to move to another location but I also don't want a gathering station close to my house. Thanks.

Could you provide some details on the legal basis that you will use?
I believe there is a state law that says a gathering station has to be a certain distance from a dwelling. Does anyone know what this distance is?

Has the company already filed an application with the RRC and probably La Salle county for the associated pipelines for the gathering station?

If I were to hazard a guess, since it is on adjoining property and not subject to city ordinances, you may just be out of luck. Shame your neighbor did not give you a head's up. On the other hand, if they want to lay a line on your land, they may be out of luck.
You know, you could go to all of the neighbors and buy 1/2 of the rights to pipeline easements over their land and batter the company to death with per rod costs to cross.
Your best bet for a good answer is to get a good attorney.
Skip building the house, and put in a 24hr steak restaurant instead. Make the parking lot huge, and have a ‘mini’ general store, and even showers & bunks. You will then become the richest man in the county, and can then buy any land in Texas you want, including the ‘gathering station’ across the street, and shut it down (if you really want to do it then)!

Might want to put some trailer pads out there and septic tanks. Throw in a few 800 sq ft cottages that you rent for $1500 per month for the big wigs. Payout on those would be less than 2 years.
