I just inherited 5 acres of Mineral Rights in Moffat County Colorado. I will need to go through probate to receive title. Is 5 acres worth the process? I do not know what oil companies look at for rights. Thank you.
I don't know about Colorado, but in Texas many title companies will rely on a properly worded and filed Affidavit of Heirship to establish title (some don't). Filing one is much less expensive than a Probate, especially a Probate with Administration. However, if there is more than one heir to the Estate, and there is some dispute or disagreement among them, a Probate probably will be necessary. Oil companies almost always look at whatever is in the public record to establish ownership from their perspective. That means Deed Records, Probate Records, and Court Records. Yes, five acres is worth it, especially if they are in production.
