2003 McClain Forced Pool Lease

In Feb of 2003 while my Dad was in Assisted Living Facility here in Houston I received a call from a Landman, Phil Montgomery, with Hal C Smith and Associates. He advised me he had sent my Dad a lease that needed signed and asked if I knew about it. I told him Dad was in Assisted Living after a major stroke and that if he would resend me the lease I would look it over. Told him I had POA for my Dad’s affairs and would be able to sign it if it met his requirements.

I never got the lease. Now doing some searching on my own, it appears that forced pooling for him and his sister occurred in March of 2003, the month my Dad passed away. I’m trying to find out what happened to that lease, if a well was drilled and if so if there is money in suspense somewhere. I have checked Oklahoma Unclaimed Money site, but didn’t see anything.

So the tract is described as Sec 7-8N-3W in McClain County with 140 NMA. There is mentioned of two more tracts, Sec 6-8N-3W and Sec22-8N-3W with 200 NMA, also. Not sure where to look any more. All of these mineral rights were owned by my Grandfather. Any help would be greatly appreciated.

There are several new leases with Continental Resources and other groups within the last 24 months, so some activity may increase. Would be advisable to go ahead and probate any wills so that the heirs can lease and perhaps get royalties from new wells.

I’m in the process of probating wills of My Grandaunt, grandfather and father in Caddo County Courts. My Aunt, Dad’s sister, did the same and formed a trust back in 2006, none of which I knew about. Is there a way to find out what happened to the pooling lease my Aunt and Dad received back in 2003 from Hal C Smith and Associates? It may not have ever gone anywhere, but I’d like to see what transpired with that lease.

If you give the section, township and range, we can help with activity. You may be confusing terms, you can either have a lease or a pooling. Hal C Smith would have offered a lease since they are a lease brokerage firm. If you do not want to share the location, you may be able to look your parent’s names up on www.okcountyrecords.com for most counties in OK. Caddo has its own site: Caddo – OSCN 7 Click the “Court Records” link at the top to see several options. I used the “Search OSCN Dockets” link on the left side. Filter by Caddo County drop-down, enter other relevant info in the “Search By Party” section to limit (or leave blank to expand) your results, then click “Go” button.

My post listed the tract in the bottom paragraph “So the tract is described as Sec 7-8N-3W in McClain County with 140 NMA.” There is also listed Sec 6-8N-3W, so there is some confusion on my end. I will try the link you provided, Thanks.

I can pull up the lease from EOG Resources signed on 2-17-2003 (by Aunt) for McClain County Sec 7-8N-3W containing 140 NMA for 3 years. There is no signed lease for my Dad’s part of the section. But how do I look up Spud dates etc on that section? Am I over my head? Probably LOL

Here is the OCC WellRecords link. There are old wells in those sections, but no new ones.

An OCC Visual Well Search was done 12-9-25 of the McPherson 1 Well, API #087-00479, Sec 22-8N-3W NW/SE. Result of the search by the Field Inspector was “No evidence of subject well”. Can you explain what this means? By the way Thanks for all you help!

We have leases in this section dated 2004 w/ EOG Resources and in 2014 w/ TS Dudley. You might reach and see if they can be of help. OKCountyRecords.com is another good resource that is easy to use.

McPherson 1 was apparently completed on 12/13/1968, but is listed as inactive. The field supervisor could find no surface evidence of the well. No production was listed.

Section 7-8N-3W has two old wells. Craig Unit B-plugged and abandoned in 1965 (NW4) and the Curry 1 plugged and abandoned in 1981. (SW4)

Section 6-8N-3W has two old wells. Jackson 1-dry hole plugged and abandoned in 1959. (SW4) Riced 1-dry hole plugged and abandoned in 1974. (NE4)

Landman got the lease

You were right, it was a Lease from Hal C smith. Got confused when I saw “Pooling” in the header of the lease.

Validus hold that section already with the Black Hawk Woodford horizontal wells. Are you getting offers for a different horizon?

Get it all up front in mcclain county. I mean all. Up front. There’s all kings of hole trouble bad fracs emulsion problems. Low pressure. Tight. Depleted. I think they only drill in McCain county so they can bring thier girlfriends and show them a rig or something. Not joking. Land of little return

I am brand new to all of this. I don’t know what horizon means? I was presented with a lease and hired an oil gas attorney to negotiate. Your business profile is impressive. I live in Houston and I inherited mineral rights in 10 counties in Oklahoma and 2 counties in Texas. Each have large acreage and multiple sections. Just trying to learn. From others comments McClain sounds bad. Should I take the higher sign bonus and 1/5 instead?
