We started receiving a few offers for our 1 acre mineral rights in Nov. 2025. We have since filed an Affidavit of Heirship with Custer County. . Section 28 of 12N-17W

The most recent offer was $4,548. How much activity is happening in this area of Custer County and does that sound like a good offer, or should I wait for more development or something to happen?

That township in Custer has extensive leasing at the moment. There is a new horizontal play developing in the Cherokee shale. Territory and Mach already have permits in the northern part of the township.

Extensive leasing and permits is also accompanied by buyers who want to get in early so that they can make a profit. Usually, their first offers are low just to see who will bite.

If the first well is successful, then you may have the benefit of additional horizontal wells in the future. Even one acre can have nice returns. You might want to sit back and wait to lease. Several companies are already leasing in your section. Wise to get an attorney to help with any lease as the agent’s draft will not be in your favor and needs significant edits.

If an attorney is not economically feasible, then wait for forced pooling as that has its advantages. Reign Operating already has OCC spacng cases pending just to the south of you for Cherokee spacing.

If it were me, I would wait for a bit and see what happens.

Thank you so much for your quick reply. We heard that Reign Operating was possibly going to sell or move (not sure of the correct term), some of development in this area over to Crawley Petroleum. That was according to the Landman I spoke with over at Penterra Services.

I am in a similar situtation with needing to file an Affidavit of Heirship with Rogers Mills County without a Will?

Actually, the AOH works better when no Will is involved according to some title examiners. However, it is often merely a band-aid. If substantial minerals are discovered most Oklahoma operators will want a probate. A probate is usually not as daunting as it may seem.

You can Google or ask help from ChatGPT for a generic “Affidavit of Heirship”.

My situation was likely different that your but my father died a widower and did have a will that was properly probated at the time. I live in Texas. I’ll try and upload a GENERIC AOH for you here. You file it with the County Clerk of that particular County. Call them first and find out particulars. Mine had a small fee to pay for them to properly file it.
