Just curious. Can a new lease be written while the minerals are in probate? Thank you!
This depends upon many factors. The executor of the decedent’s estate may require permission from the court in order to do so. Also, the order will likely need to be issued from a probate court in the state where the minerals are located. Others owning mineral interests in their own names should be able to lease their individually owned interests.
