When my mother passed away several years ago in Oregon, she had a Trust and Pour Over Will naming me as her beneficiary of anything in her name. I never knew she had mineral rights in North Dakota until I recently received a royalty check. Turns out my brother and sister somehow knew and filed a Quiet Title in 2010. He and my sister (both estranged from the family) are now sharing my mother’s royalty income, where it should have been mine alone. Do any of you know whether a Quiet Title is set in stone, or is it something that can be overturned with proof of inheritance and probate of my mother’s will in that state?
