Offer to Purchase Oil and Gas Interests

Still waiting a week later to hear back from their(Antero) owner-relations department. We just received another offer to buy our rights from Haystack Minerals out of Austin TX for $10k. So it went from $4,600 from Antero…who we have a lease with to go in and explore, to Haystack who probably wants to buy and turn around and sell for even more money. What a crazy business. Buy minerals cheap that were handed down from family, to only sell and make a profit for themselves. sigh

Antero has sent my sister affidavits of heirship when it’s already been established that we are the heirs and it’s filed with the county.

Antero didn’t tell my mother anything on how we own mineral rights there. They weren’t forth coming with her at all. Then I jumped in on it because I had no clue how we owned land without even knowing it. How do we own land we’re not even living on. That’s when I learned about mineral rights. Then I had to dig to find out who the heck on my mother’s side owned it. They have been trying to buy her rights and I believe most of my extended family sold theirs not really knowing and understanding what is going on. I’m learning a lot through this forum but still a lot to understand. It’s very frustrating.

It is very frustrating and overwhelming, especially when it is your first encounter with mineral rights. My Dad inherited the mineral rights through my Mom in 2012. No one in my family knew anything about it. Mom would have been tickled to know she had mineral rights. These mineral rights were new to my cousins too. We first used my cousin’s work attorney for the first contract. He was a corporate attorney and expensive. We didn’t know any better and in the end, I believe we had a fair deal. When other new mineral rights lease offers popped up, we used Kyle Nuttall a WV Attorney. He is fair priced. Kyle assisted in making sure that myself and siblings heirship were listed correctly with the county (I forget which department). Kyle and M_Barnes have been a wealth of information on this site.

Your story is quite confusing. You leased with Antero in 2022 for $4,600.00. Was there a well recently drilled and thats why they are asking for a W-9 that you dont want to provide? Which they have to do. The Haystack offer is to buy the the minerals that were leased in 2022, 2 completely different things.

Sorry, no, Antero had mom sign a lease to explore apparently. They now offered $4,600 to purchase the mineral rights. And just last week, Haystack offered $10k to purchase the mineral rights. No well yet.

I just wanted to chime in that Antero Owner-Relations finally got back to me. There will be a division order going through here eventually and they will need that W-9 I told you the landman sent me. I asked her to send us one when ready. But she also state that a well WILL be going in next year 2027 on the 51 acres where we have our mineral rights. The last offer from Haystack told us we have 1.8301 net acres. Antero originally told us we have less. Is there a way to find out exactly how many net acres? Or will that come in during the Division Order?

When you get the division order, it may have the net mineral acres on it. If it does not, you can ask the DO agent to give you the equation that the calculations are based upon.

It is possible to have a tract that has a certain net mineral acres, but the well spacing unit does not include all of them. So you may have two different acreage amounts based upon the criteria of the question. One could be how many of my total net acres are in a spacing unit and the other could be by a buyer who wants to buy all of the acreage owned.

I had my attorney reach out to Mr. Nutall’s office but did not get a speedy response. When you say he is fair priced what amount per hour does he charge?

It’s been just over a year since we used Kyle. I believe the charges depend on what he does for you. At the time we used him, his charges were comparable to other attorneys in WV. You would need to speak with him to get correct charges for his services.
