Depending on the value of the interest and if there has not been a probate proceeding, then you can consider a Determination of Death and Heirship proceeding. If you have everything together it should take about 6 months and cost less than $5000. If you are not the sole heir, then it becomes more complicated. You will have to talk to the other heirs and see if they agree that John intended for you to get this property. If you have that agreement, then they can deed to you and you take care of the DODH proceeding. Make sure you have someone that understands this process prepare and review any deeds.
