I’ve been asked to sign a waiver by a company that is building a battery storage facility over my mineral rights in 21-4S-2E Carter County. The waiver says I can do nothing with my mineral rights, no ingress or egress to them, and waive my rights to do anything with them. I told them I was not giving away my mineral rights. Obviously, even if there was an offer to lease, I could not. So I’m asking for compensation if they are going to prevent me from doing business. So it’s about 6.5 net mineral acres of mineral rights, so I say they owe me money to build over my rights. Anyone have a resolution to this? They agreed to $500 compensation immediately when I asked. Should I go for more? I’m not signing the waiver as is, just need to know my rights about the waiver. Don’t want it to go to court. Thank you!
Given how many OCC cases for horizontal wells are immediately to the north of you in 4S-2E, I would say a HARD NO. Their $500 seems a bit too quick and too low!

Sorry, my question was can they still build this if I dont sign the waiver. Would ghey have to get a certain % of folks to sign to be able for OCC to allow? Or whats the worst case scenario. Trying to decide whether to sell those rights if they think they are going yank them out from under me or prevent me from leasing. As you said there are wells coming that way so want to be ahead of the game. I just responded that I was not willing to sign a waiver as it affects the value and use of my mineral rights. We will see what they come back with.
I do not know if they can do it anyway.
