# What is my royalty percentage if i'm forced pulled in Montana?

If I’m forced pooled does anyone know the percentage I’ll be paid?

I am not licensed in Montana, but it is my understanding that a mineral owner would receive a 1/8 royalty until such time as the operator recovers 100% of surface equipment and operating costs and 200% of the drilling costs.

Your actual numerical percentage will of course depend on your net mineral acres relative to the size of the spacing unit, but Tim is correct. The force pooling statute in Montana calls for a 1/8th royalty until the 100%/200% risk penalty is recovered. After that you will become a working interest partner and will be responsible for your proportionate share of the costs of operation.
