What’s happening in this area as far as drilling or working wells? I own here and we are in the process of negotiating a new lease. What’s the going royalty rate these days in the area? Their initial offer was 18.75%.

3/16 is a starting offer, not a ceiling, so counter before you sign anything. For what is happening around you, the ECMC map (Colorado’s oil and gas commission, formerly the COGCC) shows permits and wells by section, so you can see whether anyone has filed on 34 or the sections around it. That matters more than a going rate: a lease in the path of a permitted horizontal is worth a higher royalty than one nobody plans to drill. Who made the offer?

I see several agents leasing in that township. The highest royalty so far is 22.5% with quite a few at 20%. Bonus amounts are not public. Most of us would prefer the higher royalty.

Bison Operating has permits pending for multi-unit horizontal wells in the northern portion of the township.

We have a current lease with a a shut- in payment (gas) so why would there be interest in securing a new lease. I reviewed the original lease which goes way back to 2005 and it looks like the shut-in is indefinite which is awful- not sure why they signed that back then, but has anything changed recently in Colorado or Weld County that would require Bison (who was assigned the lease via Civitas last year) to secure a new lease? Stonebriar Energy is who is trying to secure a new lease.

Have they paid the shut in fees every year? If they have not, then the shut in clause may be invalid due to non payment.

I did not receive the payment this year as required by the July deadline of the lease anniversary, but they sent it last year on time and it sat at the post office for three months before they delivered it so that may be the case again this year. It hasn’t produced gas since 2020 so I don’t think it’s “operational” at this point either. I suppose it’s time to engage counsel to break the lease.

Probably a good idea to find out what your legal status is at this point. You may be able to get a better lease this time around with good counsel.

Hi Queenie, here is a visual depiction of where you are and where tings are around you. Green lines are drilled wellbores and red triangles are spudded wells 🙂
