A trust terminated in 1954 when the Settlors (parents) died. The trust stipulated that the property vests into their “surviving issue” per stirpes. One son predeceases both Settlors and has no kids. Does his widow get the interest or do his siblings get the interest? Surviving issue or issue was not defined in the trust and I could not find a definition in Texas code. Thank you for your feedback.

Did Settlors have more than 1 child?

Google Search: Texas Descent and Distribution. (Compliments of Judge Russel Austin, Harris County Probate Court 1) You have not given enough information. If the son died before the parents and before the trust terminated then?

Based on facts, the deceased son’s widow is SOL.
