Jade Owls recently offered my client $16,725.48 as total compensation for revenue on 4 prolific wells that have produced since 2014. Revenue due is $73,699.61 interest $57,045.28. Any royalty owner out there who has been working on curative to clear their title to facilitate payment of revenue on producing wells, be aware, Great Horned Owls - now Jade Owls will offer you less than $.15 on the dollar and threaten litigation if you refuse to take their offer. Their excuse is the Crescent Energy (managed by KKR - an entity know for leveraged buyouts and then bankruptcy) did not turn over the suspense funds at closing (it is the responsibility of GHO to perform a proper due diligence and insure royalty owners suspense funds are in tact). Given the number of Oklahoma royalty owners in suspense in the now GHO wells, the suspense account was massive according to attorneys who worked on the class action litigation against Contango/Crescent a couple years back. KKR, manages Crescent Energy, so it is not outside the real of possibility that GHO is just a front for KKR who will do the same to the Contango/Crescent assets.

Great Horned Owls has only been in business 4 years, right before Crescent Energy assigned approximately 800 producing Oklahoma wells to GHO, they were mortgaged to the hilt. In the same time frame of the assignment, all mortgages of GHO’s were released as well as the Crescent Energy (Contango) mortgages. There was no new mortgage by GHO, and they were reportedly strapped for cash (recent linkedin post). The question being, where did the acquisition funds come from? The only logical explanation is the suspense fund was raided by GHO, Crescent Energy, or both. Did Crescent give GHO a bargain deal and take off with the suspense cash. We’ll probably never know. In June, GHO assigned all the wells to another entity, Parliament Securities SPV,LLC and mortgaged the Oklahoma wells to UMB for $166 million.

The only way you can protect yourself and eventually get paid when this company goes belly up is to file a Oil and Gas Mineral Owners’ Lien for the revenue and interest due. The 2010 Mineral Ownes’ Lien Act makes royalty owners revenue a debt with a higher priority than mortgages, so, with a lien in place, you will be paid before the mortgages, so there will be a good chance you will get you money eventually when the owls go bankrupt.

I have filed a lien for $72,000.00 against the wells. I noticed a couple of materialmen’s liens for work on wells filed as well, so there is a trend emerging.

There’s Crescent Energy operating in south Texas and west Texas currently. Is this the same operator you’re talking about here? The Crescent I’m talking about has acquired several other companies over the past couple of years and is now one of the largest gas producers in south Texas.

I thought royalties in suspense had to be kept in a trust account until it is released to be paid. Is that not true?

I have assigned a mineral owner in Garfield County,Oklahoma trying to receive transferred minerals on a well operated by GHO. The nonpayment goes back 4 years or more (I don’t have the file with me). How did you acquire the total production $ amount? How did you successfully communicate with GHO. So far they’re ghosting me. Thanks for your post!

Crescent Energy Company based in Houston is traded on NYSE as CRGY. From what I’ve read the company is flush with cash and has no outside financing. If this is the same company you’re referring to, mineral owners should be able to recover their past due royalties. On the website it doesn’t show any operations in Oklahoma. Only operations in Texas and Utah.

Yes, same one. And you are correct, the suspense funds by law are to be separate. Jade Owls claims they only got a small portion of the suspense funds, which means Crescent held on to them for their own use. Sadly, these funds are routinely used as an oil company’s own piggy bank. Interest free funding.

I used a service named Pangaea, but it is a pretty good monthly fee. You can also go to the OK tax commission oil & gas division and look up well(s) for production data. Free, but a little more difficult to use.

It’s out of OK now with the sale to GHO. Back 3 years ago I had to file liens against the Crescent wells to get paid too. They were the defendants in an OK class action litigation over not paying royalty owners statutory interest. Settled out of court for 8 million. This company has total disregard for royalty owners. Tries every trick not to pay.

Crescent is managed by KKKR, just a couple weeks ago KKR settled with JOA over litigation involving acquisitions and forged ir missing documentation. Fine was $250 million. KKR is bad to the bone.

Once I get the volume, I use pricing from other wells, or if I don’y have that, I use USEIA website. It US Energy Information Agency. If you can’t find pricing for Oklahoma Sweet Crude, use West Texas Intermediate WTI, it’s always exactly same price. You will get a monthly average so use that amount to calculate revenue.

Actual pricing in OK is usually about $5 less than WTI, Plains Marketing has lists for OK sweet and sour crude.

</div>

I usually go to Energytransfer daily posted prices, more out of habit than anything else, but I pulled up Plains Marketing Price Bulletin for 9/11/2026 and both OK Sweet and WTI are at $96.53. Maybe you were looking at a gravity adjustment? But thanks for commenting, we all learn a lot from your posts on this forum. LL

</div>

Slight clarification. The prices might be the same on websites, but the effective prices may vary by operator contracts and what prices are agreed on in those contracts. On the royalty statements, the prices are rarely as high as the online prices.

Interesting. I’ve compared my check stubs to monthly averages posted on Energy Transfer and USEIA, and more often than not my check stubs were 1-2 dollars more, occasionally 4-5 dollars more. Since I use historic average posted prices to determine what is due in revenue for filing liens against wells, I try to be very careful to make sure my figures are spot on. So far I’ve just been a few hundred to a few thousand dollars low on 5-12 years of production…I’ve never filed a lien that ended up being more than what I recovered.

Looks like the strategy is working for you. The averaging of costs can probably account for the highs and lows. You might have an operator with good contracts on sweet oil.

This raises a question for me. My client is receiving payments from Crescent Energy for Utah royalties. They aren’t very much so I’m wondering , in general, how would one go about finding out if any company has funds in suspense for you?

Contact the Royalty or Owner’s or Division Order department of the operator. Most operators have a portal.

Interesting Topic. I’m dealing with a similar situation in Texas right now. I am probably owed around 120-140K, but was given around 12K and told this was all the suspense funds transferred. I am waiting to hear from “accounting” at this point, but I am speculating they will not make this right and I’ll have to figure out what litigation looks like here.

There are two possible locations for funds. One is at the operator’s with suspense funds. They hold those funds under the states statute of limitations time frame. Generally four - seven years depending upon the state. Then the funds are transferred to the state treasurer and end up in unclaimed funds. Have you tried [www.missingmoney.com](http://www.missingmoney.com) in the states where the mineral owner lived and also Delaware.

Thank you for the response. Yeah, I’ve been down the rabbit hole. I have looked there for escheated funds. I’ve contacted the previous operators/purchasers getting confirmation that they did not escheat any funds and passed the suspense to the operator who took over. It seems there have been some accounting issues between an acquisition - and there are several years of missing revenue that has not been accounted for.

So far nobody has any notes of funds being escheated, nor do I find any independently looking.
