# Rights of land owner with a gas well

My wife and I own land in Ritchie county and there is a gas well on the property and there is no record in the courthouse what are my rights as a land owner? We bought the property about 6 years ago.

What are you wanting to do? Are you just a surface owner? Do you want the well gone, or do you want compensation for surface use? Was the well there when you bought the property? I don’t know how you can be certain that there is no record in the courthouse. I assume you mean you couldn’t find a lease for the property? Is the well producing, or is there just equipment sitting on your land doing nothing? People will probably be able to help you more if you post your legal description.
