I am party to a non-participating royalty deed in Texas. The document states the wording usual 1/8 royalty. This deed was recorded in 1981. Does a floating royalty may apply here? I own interest in three adjacent sections. All are producing. According to my calculations I am being paid 1/8 on one lease and more than 1/8 on another. The third lease I have to determine what is my NRI.

Any comments?

Whether a royalty is fixed or floating is a topic upon which there have been hundreds of Texas appellate court opinions. The exact language and the punctuation is critical. You need to take your document to an experienced oil and gas attorney to interpret for you in light of all relevant court opinions.
