I have a deed for mineral rights in Richland County, MT, including T25N, R56E, spanning several sections/quadrants.

I contacted Continental Resources to inquire about planned activities in the area and provided a list of my properties (T/R/sections/quadrants) for reference, as well as references to book and page the deed was filed under in the county recorders office.

In the response from Continental (which took 3 months to receive), I was informed that several sections from my lease did not show up in the landmans ownership report for the section.

Additional info: Probate for the family minerals in Richland County was completed in 2018, but the missing tracts are not listed there. Yet they are on the deed my mother held at the time, and on my deed when the mineral rights were transferred to me in 2024.

What could be underlying reasons for my ownership not coming up in the landman’s search, and how should I proceed to both refute findings in this case and ensure that my ownership shows up in future searches?

Thanks in advance for insights!

Check the name spelling in the index for deed records for both yourself and your mother. Letters can be reversed or left out., etc. Sometimes deeds in and out of someone are different, for example deed into X has a name has full middle name and deed out of X might be just an initial and that can be confusing. As to the missing tracts on the probate, it could be an error in filing with the court or it could be that your mother had previously sold some minerals and so those tracts were not included. So if the deed into you copied all the lands from her original deed, that will not give you title if she had already sold some tracts. Look for assignments out of your mother in the deed records prior to her death. You might also want to make sure that no minerals were deeded out of the estate into a third party before your deed.

An update here; the missing tracts in the title search were linked to complications in an older estate 3 generations back. Sorting out a course of action with legal assistance.

Another piece of information. Continental’s title search revealed a land patent between the USA and the State of Montana recorded in 2000 involving 17 tracts, including one where we own mineral interests. As such, we are told, all rights of ownership, surface and minerals, belong to the USA. How is it that this is the first time we are receiving such notification? The minerals have been passed down, there is no paperwork on the patent in the historical files kept by my family, and we have documents that prove chain-of-title dated 1948.

Do you happen to have the legals for the 17 land patent tracts. We have interests in 25-56

Thanks

May have miscounted (not 17) and they are across a range of different locations.

Check your deed for the sections in 25N-26E. The state of MT only has the east half of section 16. See if you have the other west half.

In some cases, having a deed may not be the complete title answer as someone cannot actually pass on what they do not have even though there is a document filed. An error could have happened way back in the title chain before your mom inherited. The Division Order title opinions go back to state patent and try to find all owners up to present day. It can be quite complicated.

I have interests in T25N R56E S15 S2SW, in addition to the (now invalid) E2.

Thanks for replies!

This is an interesting example of how complex mineral ownership research can become, especially when records span multiple generations.

I’m curious whether the most difficult part has been locating the older documents or determining how the different records fit together.

Situations like this really highlight the importance of understanding the complete ownership history rather than relying on any single document.
