How can I find out how much royalties were supposed to be paid to us over the last 5 years? When I go to the Tarrant County appraisal it shows like 33,000 dollars that was paid and who was it paid to and who paid the taxes on all this, because this is the first year we have received separate tax bills for the mineral and we have owned the property for almost 6 years, so now I wonder where all the rest of the money is or where it has gone.

Go to “Mineral Help” above and choose “Royalty Calculator.” It’s a real rough number that doesn’t account for severance taxes, etc., but you can deduct 10-15% from what you get in the calculator.

If you are at the appraisal district, you should be able to see who owes taxes on the production. It’s all public record.

Lori,

You can write a letter to:

Railroad Commission of TX, Office of Public Assistance, P. O. Box 12967, Austin, TX 78711-2967.

Under section 91.504, TX Natural Resources Code, the company has to reply with all information that you ask for. This letter will need to be sent certified. The Oil company has 60 days to reply. Things you need to ask are:

Itemized deductions, heating value of gas, # of the lease, well name, etc.

Then you can go to [www.rrs.state.tx.us](http://www.rrs.state.tx.us) and try to figure out what is taking place. Lots of wells in Tarrant County are shut in because of low gas prices.

What Tarrant County appraisal office is showing it total dollars. Then you have to take your % and divide with the amount of Acres you have. They don’t have to send a check for under $100. Did you get a division order?

Dear Ms. Cervantez,

The appraisal district numbers have no relation to what you were paid. Your 1099s will tell you what you were paid, as will the check stubs that you saved and put in an old cigar box.

The burden of the County Appraisal District is to determine the value of the property as of December 31 of the current tax year, not a tax on what was paid. That is the job of the severance tax (on a local level) and the Federal Income Tax on a national level. Some states have an income tax.

The burden of the Tax Collector is to collect the property taxes appraised by the tax collector.

We received help from Royalty Owner Report to determine what we were supposed to be receiving. So worth it, since it explained a lot about what we did not understand.
