Virginia—wills have been probated, death certificates have been filed and recorded, affidavits identifying people have been filed and recorded, quit-claim deeds filed and recorded. When Cathy’s mother’s will was probated there was a producing well on the property that she received a royalty check, once a year, until the well was abandoned. She owned mineral rights then, why not now? When they wanted to lease to drill she owned mineral rights, now that they owe her money they say she just might not have clear title. I suggested to the lady at the “if you have questions” telephone number that maybe her lawyer was using a little “creative employment” to make himself a job and it appeared all of this was so they could use the money over six months without paying any interest. She raised her voice an octave and said she didn’t have time to discuss it, so I must have been hitting pretty close to home.

KJ,

You can go to the assessor office or tax office in the county and they can tell you the acres. Also, some counties have plat books a person can purchase and it will give you a very close amount of acres. Supposed to be the right amount, but I have had to get some changed a couple of times.

How much money someone received for leases, that can be harder. Sometimes OCC can give you an estimate of what leases are running in the area, but it’s usually a few months late. Otherwise, just talk to your neighbor and see if they will tell you what they got. Some will love to tell you, others don’t want anyone to know.

I assumed that an oil and gas lease, on file with the County, would have specific mineral acres and dollar amounts on it. …Not so. Where would one fined this information?

Only the owners who have interest that are not leased are listed on the pooling in most cases, and must make an election if they have interest that are not leased. I would need location to look up anything.

Thanks Virginia,

I did prowl around the tax office site but I could only see surface acres. I will go back and see if I did not …“dig” down far enough.

Looking at a couple of leases for the same section (within three years), I can’t tell what is leased and what is not. I have interest in several parts of the same section and two of the leases have the same “NW/4” but cant locate a lease that show acres in another 4th. I can only assume it was “pooled”. This stuff can get confusing real fast.

Ron,

I found a copy of the pooling order with the 3/16th and 1/5th amounts. It did not list a default 1/8th amount. At the bottom of the pooling order (names and addresses), I see the trustee listed several times in dif. places. I just don’t know what was paid per acre on two leases sighned before pooling and the amount of acres leased.

KJ,

Sounds like you share part of the mineral with others. Then the tax office records will only show total acres of the 160. Have you looked on the County clerk records to see if anything has been recorded?

You should be able to find the leases there, but they may not be filed yet. Seems the oil companies are running behind on everything.

Once you get to the County Records, just type your name or name of the trust or LLP and it should bring it up. Then you can pay a small fee per month to look at the records and if you want to print them, it’s another dollar or so. It used to be where you could put the legal in and it would come up, I liked it better that way. But, seemed they changed it this past year.

It’s not my intent to clog up the forum with a bunch of questions but:

“Held by production” When does this start? Spud date? …If a three year lease expires after the spud date but befor stuff comes out of the ground, is a new lease to be had?

Virginia,

I did use the county records site and found the leases. I was hoping that they would have specific amounts of acres in specific areas (4ths). The leases show 4ths but seem to conflict. ie.: If you had …say 20 acres in a 4th., why would you lease 10 of them on one lease and the other 10 a couple of years later? …yes the acreage in this area are contiguous.

If acrege was “pooled”, would a lease for the “pooled” acres show up at some point at the county record site?

I can still search by “legal”. It’s at the bottom of the search page.
