I’m trying to figure out how to calculate interest owed on unpaid royalties within Panola County TX. Production has been small yet consistent since I took over ownership of my interest. To date I have never received a single cent in royalties despite countless attempts to recoup including formal requests via certified mail. I took over ownership of my interest back in December of 2020 with royalties owed from January 2021 production on. Seeing that we are talking about 5+ years of interest I am struggling to understand how to calculate it. I’m reading conflicting information online about how to calculate this in Texas with some claiming its based on simple interest while others say compound. If anyone could point me in the right direction that would be awesome.

You are getting ahead of yourself as you need the net monthly royalty for each month to calculate interest and that net revenue will be only be available on a statement. You first need to get in pay. Was the prior owner in pay when you acquired the minerals? Sending the recorded deed, with a transfer form and W-9, would normally get the royalties transferred. What have you heard from the operator? Is there a title issue which needs to be resolved? (Such as a break in the deed history.) Are you and/or the prior owner not in the title run so there is a question as to whether or not you own minerals? Did you or the prior owner sign a lease or are you an unleased mineral owner waiting for payout? You can search in the deed records to see whether the lease is still held by the original company lessee or has been assigned to another company. Then contact that company about the royalties. Are you sure that you are contacting the current operator?

Hi TennisDaze,

I’ve already done my due diligence on this interest. I’ve already pulled all of the production data from the RRC and cross referenced it with Oil/Gas/Condensate sale prices for similar operators across the same time frame. The previous owner and operator were in good standing before the new operator took over. I spoke with the operator via email and on the phone to try and get ownership of this interest updated. After providing them with the appropriate documentation they completely ghosted me. I’ve done everything I can up to this point I am simply trying to figure out how to calculate interest on what is owed so I can prepare to file suit.

If the well(s) are producing, then you would look at the TX CONG data filed for those wells, not for other wells and operators. Is the operator filing production reports with the RRC and not filing sales with the TX CONG? If it is a 5 digit RRC lease #, be sure to enter a leading 0 on the CONG to make it 6 digits. Lawsuits are very expensive and rarely a first step. Has your attorney contacted the operator about the royalties? For certified demand letter preparing for a lawsuit, you should be sure to send one to the registered agent, not just the operator’s office address. Your attorney can give you the best advice if you are intending to file a lawsuit.
