Hey, Wade! Thanks for your reply! I would agree with you that it is a very fact-specific issue. I gave links to several cases in the article, in case people wanted to know the specifics of each detailed test. But my goal was to leave out as much legalese as possible, so I didn’t include the language the courts are using. Instead, like you said, I just gave a very generalized summary.
